These Terms of Sale ("Terms") govern your purchase of products from DRAGNZ PEPS ("DRAGNZ PEPS," "we," "us," or "our") through this website. By placing an order, you agree to these Terms and to our Research-Use Policy and Privacy Policy. If you do not agree, do not place an order.
Research use only. All products are sold strictly for in-vitro laboratory research by qualified persons aged 21 or older. They are not drugs, supplements, foods, or cosmetics, and are not for human or veterinary use. See our Research-Use Policy.
1. Order Acceptance
Your submission of an order is an offer to purchase. All orders are subject to acceptance by us. An order confirmation acknowledges receipt of your order; it does not constitute acceptance. A contract is formed only when we dispatch the products or send a notice of acceptance.
We may refuse, limit, cancel, or reject any order at our discretion, including where an order appears intended for human or animal use, where it suggests non-research use, where stock is unavailable, where a pricing or description error has occurred, or where we suspect fraud or a violation of these Terms. If we cancel an order for which you have already paid, we will issue a full refund.
2. Eligibility & Compliance with State and Local Laws
You must be at least 21 years old and a qualified researcher to place an order. By ordering, you represent and warrant that your purchase, possession, and intended research use of the products are lawful in your state, county, and municipality, and that you will comply with all applicable federal, state, local, and institutional laws and regulations.
Certain compounds may be restricted, controlled, or prohibited in some states or localities. You are solely responsible for knowing and complying with the laws that apply to you. We reserve the right, at our sole discretion and without liability, to refuse, limit, cancel, or restrict any order or shipment to any state, territory, or jurisdiction where a product is restricted, or where we believe an order may be intended for an unlawful or non-research purpose. Where an order is refused or cancelled for these reasons after payment, we will issue a full refund.
3. Pricing
- Prices are listed in U.S. dollars (USD) and are exclusive of shipping and any applicable taxes, which are shown at checkout.
- Prices may change at any time, but changes do not affect orders we have already accepted.
- Despite our efforts, products may occasionally be mispriced. Where a product's correct price is higher than the price shown, we will, at our discretion, contact you for instructions before dispatch or cancel the order and notify you.
4. Payment Terms
Payment is processed securely by Stripe, our third-party payment processor. We do not receive or store your full card details. By paying, you authorize us, via Stripe, to charge your selected payment method for the order total, including shipping and taxes. Payment must be received and cleared in full before an order is dispatched. Your use of Stripe is also subject to Stripe's terms and privacy policy.
5. Shipping & Delivery
- Eligible orders are packaged in plain, unbranded packaging and dispatched within 24 hours on business days, with tracking provided on every order.
- Standard shipping is free on orders over $150; on orders of $150 or less a flat shipping fee is shown at checkout.
- An optional expedited next-day service is available at checkout for a flat $35, subject to carrier availability for your delivery address.
- Delivery estimates are estimates only and are not guaranteed. Risk of loss and title pass to you upon delivery to the carrier.
- You are responsible for providing an accurate, complete shipping address. We are not responsible for delays or losses caused by an incorrect address or by the carrier.
6. Returns & Refunds
Because of the nature of research compounds, we cannot accept returns of opened, used, or unsealed vials. We will, however, replace or refund a product if:
- it arrives damaged, mislabeled, or materially out of specification against its certificate of analysis; or
- we shipped the wrong item.
Report any such issue within 14 days of delivery via Support, with your order number and, where relevant, photographs of the items and the packaging. Approved replacements are shipped at no cost; approved refunds are issued to the original payment method via Stripe, typically within 5 to 10 business days depending on your financial institution. An order may be cancelled for a full refund up until it has been processed for shipping; once a tracking number has been generated, the order can no longer be cancelled. We do not accept returns based on change of mind.
7. No Warranties (Sold "As Is")
Except for each product's conformance to the specifications stated on its certificate of analysis, all products are provided strictly "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that any product is suitable for any application beyond legitimate laboratory research, and no advice or information obtained from us creates any warranty not expressly stated in these Terms.
8. Limitation of Liability
To the fullest extent permitted by law, DRAGNZ PEPS and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your purchase or use of any product, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to a product shall not exceed the amount you paid for that product. You assume all responsibility and risk for the handling, storage, use, and disposal of products once they leave our custody.
9. Indemnification
You agree to defend, indemnify, and hold harmless DRAGNZ PEPS and its officers, employees, agents, and suppliers from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use, handling, storage, or disposal of any product; (b) your breach of these Terms or of our Research-Use Policy; (c) any use of a product for human or animal consumption or any non-research purpose; or (d) your violation of any applicable law or the rights of any third party.
10. Dispute Resolution & Arbitration
Most concerns can be resolved quickly through Support, and we ask that you contact us first. Any dispute, claim, or controversy arising out of or relating to these Terms or your purchase that cannot be resolved informally shall be settled by binding arbitration administered under the rules of a recognized arbitration body, conducted in the state in which DRAGNZ PEPS is organized, rather than in court, except that either party may bring qualifying claims in small-claims court.
Class-action waiver. Disputes will be arbitrated only on an individual basis; you and DRAGNZ PEPS each waive any right to bring or participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing dragnzpeps@gmail.com within 30 days of your first order.
11. Governing Law
These Terms are governed by the laws of the United States and of the state in which DRAGNZ PEPS is organized, without regard to conflict-of-laws principles. Subject to the arbitration provision above, you agree to the exclusive jurisdiction of the state and federal courts located there for any dispute arising out of or relating to these Terms or your purchase, to the extent permitted by law.
